Is Escorting Legal in Spain? The Position in Plain Terms

Selling sexual services between consenting adults is not in itself a criminal offence in Spain. An adult doing this is not committing a crime by doing it, and at national level neither is the person paying.

What is criminal is everything built around coercion and third-party profit. Living off another person's prostitution, organising it, or pressuring somebody into it — proxenetismo, in the usual shorthand — is prosecuted, as is any involvement of anyone under age, and trafficking is a serious offence in its own right.

That distinction is the whole point. The law is not indifferent to the industry; it is pointed at exploitation inside it.

Spain has no national licensing scheme for sex work, no register, no permit and no official health certificate. There is nothing to apply for, so there is nothing anybody can display — unlike the European countries that do run formal systems of registration and taxation.

Be sceptical, then, of any agency describing itself as licensed, certified or government-approved for this work. No authority issues such a thing, so the claim is decoration. The flip side of an unregulated space is that its costs fall on the women working in it: no formal status, no employment protections, and a heavy reliance on their own judgement about who they agree to see.

Because there is no national framework, most of the visible rule-making happens locally. Several autonomous communities and a good many municipalities have public-order ordinances covering solicitation and negotiation in public space — streets, roadsides, parks, sometimes vehicles — usually enforced through administrative fines, in some places against both parties. The detail changes from one town to the next.

The Balearics are no exception, and municipal ordinances here address street-level activity and public order in broadly the same way. What those rules govern is conduct in public, not two adults arranging privately to meet. A pre-arranged visit to a hotel in Ibiza Town or a villa outside Sant Antoni is a different situation from anything happening on a pavement — worth establishing which of the two any rule you read about is aimed at.

The area that has genuinely shifted in recent years is advertising. Restrictions on publicising sexual services have been tightened, and the direction of travel has been towards fewer permitted channels rather than more.

This is why serious operators in Spain describe what they do in terms of company, time and introductions, and why you will not find a menu of acts with prices attached on a reputable site. It is not coyness — it reflects the rules the sites work under. For a visitor to Ibiza the realistic risks are commercial rather than criminal. Deposits sent to accounts that go quiet. Photographs belonging to somebody else entirely. A woman who arrives with a man waiting downstairs taking a share — which is precisely where the criminal law does bite, and a reason to care about who you are dealing with rather than about your own position.

Reduce the risk the dull way. Deal with people who will answer a specific question specifically, do not transfer money to strangers, get the time, place and duration agreed in writing before anyone travels, and walk away if the arrangement looks managed by a third party.
